Michael A. Winkleman of Miami based maritime law firm Lipcon, Margulies & Winkleman, P.A. () files lawsuit on behalf of two crewmembers who were, according to the suit, held hostage for eight months by Somali Pirates in case #3:2012cv00879 in the United States Second Circuit District Court of Connecticut.
According to the suit, Plaintiffs BAHRI CHIRAG and DANGWAL SANDEEP were crewmembers aboard the M/V Marida Marguerite when Somali Pirates hijacked it in May 2010 in the Gulf of Aden. According to the case, Chirag and Sandeep, along with approximately twenty other crewmembers, were held hostage for roughly eight months while prolonged ransom negotiations continued with the Somali pirates. The case alleges that during that time the crewmembers were physically, mentally and psychologically tortured.
The lawsuit was filed against ship owner(s) MT MARIDA MARGUERITE SCHIFFFAHRTS AND MARIDA TANKERS INC., and HEIDMAR, INC., the alleged general agent and commercial manager of the vessel. Suit was filed in the United States District Court in Connecticut, the same location as the U.S. headquarters of Defendant Heidmar.
The suit alleges the Defendant(s) were negligent as a matter of law for violating the Maritime Transportation Security Act of 2002, which was enacted to address maritime transportation security and to prevent potential transportation security incidents. The suit also alleges Defendants were negligent in, among other things, navigating through waters that were known to be pirate infested and failing to have adequate security to guard against such a threat.
