Jane Doe v Royal Caribbean Cruises LTD and Arvin Mirasol

Lipcon, Margulies & Winkleman, P.A. has filed a class action lawsuit against Royal Caribbean Cruises LTD arising from one of its stateroom attendants hiding cameras in passenger cabin bathrooms for almost three months in 2023-2024. The stateroom attendant was arrested after some of Lipcon, Margulies & Winkleman, P.A.’s clients found and reported the hidden camera in their bathroom; and the stateroom attendant was ultimately convicted and sentenced to 30 years in Federal prison.  The class action lawsuit was filed on behalf of one of the passenger victims – identified as Jane Doe – and “all other similarly situated passengers” and alleges that Royal Caribbean “knew or should have known sexual assaults were reasonably foreseeable considering the prevalence of sexual assaults aboard their cruise ships” as well as a prior incident of video voyeurism which occurred aboard another Royal Caribbean cruise ship in 2023.  Despite the prior incidents of sexual assaults and video voyeurism aboard Royal Caribbean ships, LMW’s lawsuit alleges that the company failed to provide sufficient security, training or supervision to prevent, or warn about, the nearly three months of victimization by Royal Caribbean’s stateroom steward on the passengers assigned to cruise staterooms he serviced..

The recent class action lawsuit marks a significant and troubling chapter in the ongoing battle against cruise ship voyeurism. The putative class action lawsuit: Jane Doe v Royal Caribbean Cruises LTD and Arvin Mirasol, seeks justice for the victims of a deeply disturbing invasion of privacy that occurred aboard the Symphony of the Seas between December 1, 2023, and February 26, 2024. The lawsuit highlights the urgent need for enhanced security measures and accountability within the cruise industry to protect passengers from such egregious violations.

Arvin Mirasol, a former stateroom attendant, is at the center of this scandal. Currently serving a 30-year sentence in federal prison, Mirasol was found guilty of hiding cameras in passenger cabin bathrooms and recording both children and adults during their most private moments. His actions extended beyond mere voyeurism; he reportedly hid under beds to capture videos of unsuspecting passengers showering. This behavior not only constitutes a severe breach of privacy but also underscores the alarming rise of sexual assaults, including voyeurism, on cruise ships.

“Who knows how many countless numbers of pornographic images of these unsuspecting passengers will be circulating on the internet forever because Royal Caribbean failed to protect their privacy and allowed Mirasol to make these passengers victims,” said our named partner Jason Margulies in an interview with the  New York Post.

The cruise line also allegedly did not notify Mirasol’s potential victims who stayed in Royal Caribbean cabins serviced by Mirasol between Dec. 1, 2023 and Feb. 26, 2024. There may be up to 960 impacted passengers, according to the complaint.

The victims of this case deserve justice and compensation for the violation of their privacy and the trauma they have endured. It is imperative that cruise lines take proactive steps to ensure the safety and well-being of their passengers, restoring trust and confidence in the industry. The time for action is now, and the responsibility lies with the cruise lines to protect their passengers from such heinous acts.
